Customer Agreement

The undersigned Applicant hereby requests SCDOT to permit encroachment on SCDOT right of way as described herein. It is expressly understood that every encroachment, if and when constructed, shall be installed in accordance with the sketch attached hereto and made a part hereof. Applicant agrees to comply with and be bound by SCDOT's "A Policy for Accommodating Utilities on Highways Rights of way", "Standard Specifications for Highway Construction", the "General Provisions" and "Special Provisions", attached hereto or made a part hereof by reference, during the installation, operation and maintenance of said encroachment within SCDOT's right of way.

DISCHARGES OF STORM WATER AND NON-STORM WATER: Work within State Highway right of way shall be conducted in compliance with all applicable requirements of the National Pollutant Discharge Elimination System (NPDES) permit(s) issued to SCDOT, to govern the discharge of storm water and non-storm water from SCDOT properties. Work shall also be in compliance with all other applicable Federal, State and Local laws and regulations, and with SCDOT's Encroachment Permits Manual and the encroachment permit. The encroachment permit will not be issued until Applicant has received an NPDES construction permit from SC Department of Health and Environmental Control.

Applicant and Permittee agrees to comply with all current SCDOT Standards Specifications for Highway Construction including all Supplemental Technical Specifications. Applicant and Permittee hereby further agrees, and binds his/her/its heirs, personal representatives, successors and assigns, to assume any and all liability for accidents or injuries to persons, or damage to property, including the highway and all SCDOT facilities in the right of way, that may be caused by the construction, maintenance, use, moving or removing of the physical appurtenances contemplated herein.

General Provisions

Application for Encroachment Permit
General Provisions

DEFINITIONS: The word "Permittee" used herein shall mean the name of the person, firm, or corporation to whom this permit is addressed, his, her, its, heirs, personal representatives, successors and assigns. The word "DEPARTMENT" shall mean the South Carolina Department of Transportation.
ONE PERMIT INTENT: This permit is intended to eliminate the necessity of applying to the Department for separate permits in multiple counties within one district only. Where work will encroach into neighboring districts, the Permittee shall apply for a separate permit for that district. This permit is not intended for work that does not encroach into neighboring counties, breaks continuity of any length, or for work other than fiber optic broadband utilities. The Department reserves the right to request the Permittee to apply for individual permits that lie outside the scope of this permit.
NOTICE PRIOR TO STARTING WORK: Before starting the work contemplated herein within the limits of the highway right of way, the Department’s District Permit Engineer and Resident Maintenance Engineer in the district and county in which the proposed work is located, shall be notified 24 hours in advance so that a representative may be present during the work.
PERMIT SUBJECT TO INSPECTION: This permit shall be kept at the site of the work at all times while said work is under way and must be shown to any representative of the Department or law enforcement officer on demand.
PROTECTION OF HIGHWAY TRAFFIC: The Permittee shall be responsible for the protection of the highway traffic at all times during the construction, maintenance, removing or moving of the encroachment permitted herein. Detours, barricades, warning signs and flagmen, as necessary, shall be provided by and at the expense of the Permittee and shall be in accordance with the "Manual on Uniform Traffic Control Devices" (MUTCD). The work shall be planned and carried out so that there will be the least possible inconvenience to the motoring public. The Permittee agrees to observe all rules and regulations of the Department while carrying on the work contemplated herein and take all other precautions that circumstances warrant.
STANDARDS OF CONSTRUCTION: All work shall conform to the Department’s standards of construction and shall be performed in a workman-like manner. The Permittee shall make adequate provisions for maintaining the proper drainage of the highway as it may be affected by the encroachment permitted herein. All work shall be subject to the supervision and satisfaction of the Department.
FUTURE MOVING OF PHYSICAL APPURTENANCES: If, in the opinion of the State Highway Engineer, it should ever become necessary to move or remove the physical appurtenances, or any part thereof contemplated herein, on account of change in location of the highway, widening of the highway, or for any other sufficient reason, such moving shall be done on demand of the Department at the expense of the Permittee.
RESTORATION OF HIGHWAY FACILITIES UPON MOVING OR REMOVING OF PHYSICAL APPURTENANCES: If, and when, the physical appurtenances contemplated herein shall be moved or removed, either on the demand of the Department or at the option of the Permittee, the highway and facilities shall immediately be restored to their original condition at the expense of the Permittee.
COSTS: All work in connection with the construction, maintenance, moving or removing of the physical appurtenances contemplated herein shall be done by and at the expense of the Permittee.
ADDITIONAL PERMISSIONS:
(a) It is distinctly understood that this permit does not in any way grant or release any rights lawfully possessed by the abutting property owners. The Permittee shall secure any such rights, as necessary, from said abutting property owners.

(b) The Permittee shall be responsible for obtaining all other approvals or permits necessary for installation of the encroachment from other government entities.

(c) There shall be no excavation of soil nearer than two feet to any public utility line or appurtenant facility except with the consent of the owner thereof, or except upon special permission of this Department after
an opportunity to be heard is given the owner of such line or appurtenant facility.
ADDITIONAL WORK PERFORMANCE:
(a) All crossings over the highway shall be constructed in accordance with "Specifications for Overhead Crossings of Light and Power Transmission Lines and Telegraph Lines over each other and over Highway Rights of Way in South Carolina," as approved by the Public Service Commission of South Carolina and effective as of date of this permit.

(b) All tunneling, boring, or jacking shall be done in such a way as not to disturb the highway surfacing.

(c) No pavement shall be cut unless specifically authorized herein.

(d) No excavation shall be nearer than three feet to the edge of pavement unless specifically authorized herein.

(e) Underground facilities will be located at minimum depths as defined in the "Utility Accommodations Manual" for the transmittant, generally as follows: 4 feet minimum for hazardous or dangerous transmittant, 3 feet minimum for other lines. The Department may approve shallower depths if adequate protection is provided. Such approval must be obtained in writing.

(f) Service and other small diameter pipes shall be jacked, driven, or otherwise forced underneath the pavements on any surfaced road without disturbing the pavement. The section under the highway pavement and within a distance of three (3) feet on either side shall be continuous without joints.

(g) Any vegetation removed due to the permitted work, should be replaced in accordance with the Department's "Standard Specifications For Highway Construction" and the "Supplemental Technical Specifications" for seeding (SC-M-810-3), and at the expense of the Permittee.
ACCESS:
(a) Permittee is responsible for maintaining reasonable access to private driveways during construction.

(b) It is expressly provided that, with respect to any limited access highway, the Permittee shall not have or gain access from the main traveled way of the highway, or the on or off ramps to such facility, except upon approval by the Department.
AS-BUILT PLANS: The Permittee shall provide the Department with survey-quality as-built plans in accordance with the requirements set forth in the Department's "A Policy for Accommodating Utilities on Highway Rights of Way ".
LANE CLOSURE RESTRICTIONS: This Permit covers standard lane closure operations between the hours of 9 a.m. and 4 p.m. for work described herein on roadways that do not have dedicated lane closure restrictions at the time of work performed. For any extended closures, a Traffic Control Plan shall be submitted and must be approved by SCDOT prior to work commencing. There are hourly lane closure restrictions on some roadways. Contact the local SCDOT maintenance office for a listing of restricted roadways.
REPORTING: Once per month, the Permittee shall provide the SCDOT District Permit Engineer an electronic or scanned written report listing each work location during the preceding month. The report should be uploaded to the Department’s Encroachment Permit Processing System (EPPS). In addition, work planned for the following month shall also be reported. At a minimum, this report shall provide the date, road names, road numbers, address/location, work performed, and installation method for all work performed under this Permit.

SCOPE: This Encroachment Permit (hereinafter, the "Permit") grants the Applicant permission to install equipment to measure water surface elevations within SCDOT Rights-Of-Way. Any site location must have already been selected by SCDOT’s Hydraulic Design Support Office (HDSO). All parties must adhere to SCDOT’s requirements and guidance for equipment installation.
PURPOSE: This Permit allows the Applicant to install equipment to measure water surface elevations within SCDOT Rights-Of-Way. This Permit is limited to Applicants that are doing work for SCDOT or SCDOT’s state and federal partners.
ROUTE LIMITATIONS: This Permit is valid only for low volume secondary roads in rural areas.
Equipment Limitations and Maintenance: This Permit is limited to the installation of sensors for measuring water surface elevation. Only approved types of sensors may be used, and all installations must adhere to the detailed requirements set forth in the installation plan. Maintenance of the equipment, including quarterly site visits, annual checks, and compliance with survey and safety procedures, must be conducted regularly.
Required Encroachment Permit Attachments: The permit request shall include an Installation Plan following the SCDOT-provided template and requirements. This should include details for the specific site, a list of materials to be used, site locations, elevations, diagrams of the installation for the specific bridge, a removal plan, and any additional items requested by SCDOT encroachment permit review staff. The Applicant will submit an installation plan as part of an encroachment permit to the District for review. The District should include Hydraulic Design Policy Engineer (HDPE) and the District Bridge Engineer (DBE) in the Review. The District can include the Bridge Management Office (BMO) when the DBE determines that a more in-depth structural review for the installation is needed. SCDOT will not approve the installation plan until all comments have been resolved.
APPLICANT RESPONSIBILITIES:
a) Notification of Installation: Inform the District Bridge Engineer (DBE), District Maintenance Engineer (DME), Hydraulic Design Policy Engineer (HDPE), and the Resident Maintenance Engineer (RME) of the planned installation schedule.

b) Completion Notification: Inform the District Bridge Engineer (DBE), District Maintenance Engineer (DME), Hydraulic Design Policy Engineer (HDPE), and the Resident Maintenance Engineer (RME) upon completion of installation.

c) Issue Reporting: Report any issues with the gage and method of providing data to HDSO within one (1) business day.

d) Quality Control and Assurance: QC/QA will be performed on gage data by a human once per year and published in a document which is sent to HDSO.

e) Site Visits: Visit the installation site in person four (4) times per year to carry out maintenance, check reading with at-site measurements, and physical checking and review of gage components and position. Special provisions will apply for coastal environment, tidally affected, or brackish water sites.

f) Survey Requirements: Adhere to the SCDOT Survey Manual, and reference the National Geodetic Survey monuments before site surveys. Survey all gage benchmarks, bridge low chords, and centerline deck elevations. Provide all Elevation, Easting, and Northing data to the HDSO using NAVD88. Check NAVD88 benchmark elevations annually and report the results to the HDSO.

g) Progress Reporting: Submit a quarterly progress report to the HDPE.

h) The Applicant or their contractor will perform all work and provide all equipment for the installation the equipment.

i) All work done by the Applicant will follow approved practices and guidance from the DBE, BMO and HDSO.
TRAFFIC CONTROL OBLIGATIONSS: Adequate provisions must be made to protect the traveling public, including pedestrians, at all times. The Applicant is responsible for providing all necessary traffic control devices, such as barricades, warning signs, arrow boards, flaggers. All work shall be planned and executed to minimize inconvenience to the traveling public.
WORK STANDARDS: All work must conform to the latest editions of SCDOT’s Standard Specifications for Highway Construction, and the Federal Highway Administration’s Manual on Uniform Traffic Control Devices (MUTCD). Adequate provisions must be made for maintaining the proper drainage of roadways and bridge decks. Upon completion of the work, the Right-Of-Way must be restored to its original condition. All work is subject to SCDOT’s supervision and approval. The RCE and DBE will be responsible for inspection of the attachment between the Applicant’s equipment and any SCDOT structure. The District will monitor the work and coordination. The DBE will coordinate with the HDPE on any issues related to the Applicant.
ACCESS: The Applicant is responsible for maintaining reasonable access to private driveways and properties during all phases of construction and maintenance.
REMOVAL AT OPTION OF SCDOT: SCDOT may revoke this Permit at any time upon written notice to the Applicant. Failure to comply with the requirements, including reporting, may result in the revocation of this and future blanket permits. Additionally, SCDOT reserves the right to require the Applicant to remove all traffic control devices and equipment and restore normal traffic flow at any time deemed necessary.
RIGHTS OF ABUTTING PROPERTY OWNERS: This permit does not grant or release any rights lawfully held by the abutting property owners. The Applicant must secure any necessary rights from these owners prior to commencing work.
REPAIR OF RIGHTS-OF-WAY UPON REMOVAL: If the equipment and connections installed under this Permit are relocated or removed, either at SCDOT's request or at the option of the Applicant, the Applicant must immediately restore the affected portions of bridge, highway, and facility to their original condition at the Applicant's expense.
LIABILITY AND INDEMNIFICATION: The Applicant agrees and binds its successors and assigns to be responsible for any and all damages or injuries to persons (including death) or damage to property, including the highway, that may be caused by the Applicant or its agents in connection with the work. The Applicant further agrees to be responsible for all claims and/or costs arising from the work. The Applicant shall indemnify and hold harmless SCDOT from any and all loss, damage, cost, or expense of any kind that SCDOT may suffer, sustain, or for which SCDOT may be threatened with liability, by reason of construction, maintenance, existence, or use of any equipment contemplated herein. This indemnification does not extend to any situation where SCDOT is solely at fault for the loss, damage, cost or expense. Neither the execution of this Permit nor the issuance of any permit in connection therewith shall be construed to expand the Applicant’s legal obligations to any third party.
DISCHARGES OF STORM WATER AND NON-STORM WATER: All work within SCDOT Rights-Of-Way must comply with the applicable requirements of the National Pollutant Discharge Elimination System (NPDES) permit(s) issued to SCDOT, which govern the discharge of storm water and non-storm water from its properties. Additionally, the work must adhere to all other relevant federal, state, and local laws and regulations, as well as SCDOT's specific requirements. Where applicable, the Applicant must obtain an NPDES construction permit from the South Carolina Department of Health and Environmental Control (DHEC).
PERMIT SUBJECT TO INSPECTION: A copy of this approved permit and the approved SCDOT Form 604 must be kept at the work site at all times while work is in progress and must be presented to any SCDOT representative or law enforcement officer upon request.
EXPIRATION DATE: This permit, concerning the installation of equipment and connections, shall expire one year from the date of issuance.

DEFINITIONS: The term "Permittee," as used herein, refers to the individual, firm, or corporation to whom this permit is issued, including their heirs, personal representatives, successors and assigns. The term "Department" refers to the South Carolina Department of Transportation (SCDOT).
SCOPE OF WORK: This Encroachment Permit ("Permit") grants the Applicant permission to remove vegetation within the defined "window" of an outdoor advertising sign location within SCDOT Rights-Of-Way. All activities must comply with the specifications outlined in the associated Outdoor Advertising (ODA) permit and ODA Vegetation Agreement. The guidelines and requirements specified in this Permit are in addition to those outlined in the Vegetation Agreement. The Applicant must obtain a pre-approved ODA application from the ODA office prior to applying for this Encroachment Permit. Proof of the pre-approved ODA application must be submitted with the encroachment permit application.
WORK PERFORMANCE AND PERMISSIONS:
a) The Permittee is responsible for obtaining all necessary approvals or permits for the encroachment work from other government entities.

b) Excavation within two feet of any public utility line or appurtenant facility is prohibited unless consent is obtained from the utility owner, or special permission is granted by the Department after the utility owner has been given an opportunity to be heard.

c) Cutting of pavement is strictly prohibited.

d) Any clearing or excavation within three feet to the edge of pavement is not permitted unless expressly authorized by a special provision of this Permit.
NOTICE PRIOR TO STARTING WORK: The Department's Resident Maintenance Engineer (RME) in the county where the proposed work is located must be notified 24 hours before commencing any work within Rights-Of-Way. This ensures the RME has the opportunity to be present while the work is in progress.
PERMIT SUBJECT TO INSPECTION: A copy of this approved permit and the approved ODA Vegetation Agreement must be kept at the work site at all times while work is in progress and must be presented to any SCDOT representative or law enforcement officer upon request.

The Permittee must ensure proper drainage of the highway is maintained and not adversely affected by the work authorized by this Permit. All work is subject to the supervision and approval of the Department.
FUTURE RELOCATION OF PHYSICAL APPURTENANCES: If the State Highway Engineer determines that the physical appurtenances authorized by this Permit must be relocated or removed due to changes in highway location, highway widening, or any other valid reason, the Permittee shall, upon the Department's demand, complete the relocation or removal at their own expense.
RIGHT TO REVOKE AND REMOVE: SCDOT may revoke this Permit at any time upon written notice to the Applicant. Failure to comply with the requirements, may result in the revocation of this and future encroachment permits. Additionally, SCDOT reserves the right to require the Applicant to remove all traffic control devices and equipment and restore normal traffic flow at any time deemed necessary.
ALL WORK AT SIGN OWNER’S EXPENSE: All work must be performed by the Applicant’s personnel and at the Applicant’s expense.

Unless otherwise defined, "right of way" (or, "ROW") used herein or in any publication referenced herein means the public way for the purpose of vehicular travel including the entire area used for roadways, pedestrian facilities, cyclist facilities, bridges, tunnels, viaducts, drainage structures, and all other facilities commonly considered component parts of highways, streets, or roads whether the area is owned by SCDOT in fee or used by SCDOT by easement.

For any extended closures, a Traffic Control Plan shall be submitted and must be approved by SCDOT prior to work commencing. There are hourly lane closure restrictions on some roadways. Contact the local SCDOT maintenance office for a listing of restricted roadways.

DEFINITIONS: The word "Permittee" used herein shall mean the name of the person, firm, or corporation to whom this permit is addressed, his, her, its, heirs, personal representatives, successors and assigns. The word "DEPARTMENT" shall mean the South Carolina Department of Transportation.
NOTICE PRIOR TO STARTING WORK: Before starting the work contemplated herein within the limits of the highway right of way, the Department's Resident Maintenance Engineer in the county in which the proposed work is located shall be notified 24 hours in advance so that he may be present while the work is under way.
PERMIT SUBJECT TO INSPECTION: This permit shall be kept at the site of the work at all times while said work is under way and must be shown to any representative of the Department or law enforcement officer on demand.
PROTECTION OF HIGHWAY TRAFFIC: The applicant shall be responsible for the protection of the highway traffic at all times during the construction, maintenance, removing or moving of the encroachment permitted herein. Detours, barricades, warning signs and flagmen, as necessary, shall be provided by and at the expense of the Permittee and shall be in accordance with the "Manual on Uniform Traffic Control Devices" (MUTCD). The work shall be planned and carried out so that there will be the least possible inconvenience to the motoring public. The Permittee agrees to observe all rules and regulations of the Department while carrying on the work contemplated herein and take all other precautions that circumstances warrant.
STANDARDS OF CONSTRUCTION: All work shall conform to the Department’s standards of construction and shall be performed in a workman-like manner. The applicant shall make adequate provisions for maintaining the proper drainage of the highway as it may be affected by the encroachment permitted herein. All work shall be subject to the supervision and satisfaction of the Department.
FUTURE MOVING OF PHYSICAL APPURTENANCES: If, in the opinion of the State Highway Engineer, it should ever become necessary to move or remove the physical appurtenances, or any part thereof contemplated herein, on account of change in location of the highway, widening of the highway, or for any other sufficient reason, such moving shall be done on demand of the Department at the expense of the Permittee.
RESTORATION OF HIGHWAY FACILITIES UPON MOVING OR REMOVING OF PHYSICAL APPURTENANCES: If, and when, the physical appurtenances contemplated herein shall be moved or removed, either on the demand of the Department or at the option of the Permittee, the highway and facilities shall immediately be restored to their original condition at the expense of the Permittee.
COSTS: All work in connection with the construction, maintenance, moving or removing of the physical appurtenances contemplated herein shall be done by and at the expense of the Permittee.
ADDITIONAL PERMISSIONS:
(a) It is distinctly understood that this permit does not in any way grant or release any rights lawfully possessed by the abutting property owners. The Permittee shall secure any such rights, as necessary, from said abutting property owners.

(b) The Permittee shall be responsible for obtaining all other approvals or permits necessary for installation of the encroachment from other government entities.

(c) There shall be no excavation of soil nearer than two feet to any public utility line or appurtenant facility except with the consent of the owner thereof, or except upon special permission of this Department after an opportunity to be heard is given the owner of such line or appurtenant facility.
ADDITIONAL WORK PERFORMANCE:
(a) All crossings over the highway shall be constructed in accordance with "Specifications for Overhead Crossings of Light and Power Transmission Lines and Telegraph Lines over each other and over Highway Rights of Way in South Carolina," as approved by the Public Service Commission of South Carolina and effective as of date of this permit.

(b) All tunneling, boring, or jacking shall be done in such a way as not to disturb the highway surfacing.

(c) No pavement shall be cut unless specifically authorized herein.

(d) No excavation shall be nearer than three feet to the edge of pavement unless specifically authorized herein.

(e) Underground facilities will be located at minimum depths as defined in the "Utility Accommodations Manual" for the transmittant, generally as follows: 4 feet minimum for hazardous or dangerous transmittant, 3 feet minimum for other lines. The Department may approve shallower depths if adequate protection is provided. Such approval must be obtained in writing.

(f) Service and other small diameter pipes shall be jacked, driven, or otherwise forced underneath the pavements on any surfaced road without disturbing the pavement. The section under the highway pavement and within a distance of three (3) feet on either side shall be continuous without joints.
ACCESS:
(a) Permittee is responsible for maintaining reasonable access to private driveways during construction.

(b) It is expressly provided that, with respect to any limited access highway, the Permittee shall not have or gain access from the main traveled way of the highway, or the on or off ramps to such facility, except upon approval by the Department.
DRIVEWAYS:
(a) The existing crown of the highway shall be continued to the outside shoulder line of the highway.

(b) If the driveway or approach is concrete pavement, the pavement shall be constructed at least 6 inches thick and with a minimum of class 2500 concrete. There shall be a bituminous expansion joint, not less than 3/4 inches in thickness, placed between the highway paving and the paving of the approach for the full width of the approach.
BEAUTIFICATION:
(a) All trees, plants, flowers, etc. shall be placed in accordance with the provisions specifically stipulated herein.

(b) All trees, plants, flowers, etc. shall be maintained by, and at the expense of, the Permittee and the provisions of this permit shall become null and void, if and when said Permittee ceases to maintain aid trees, plants, flowers, etc.
AS-BUILT PLANS:
(a) The applicant shall provide the Department with survey-quality as-built plans in accordance with the requirements set forth in the Department's "A Policy for Accommodating Utilities on Highway Rights of Way".
COMPLETE STREETS:
Reference Departmental Directive 28, "Complete Streets". For encroachment permit types that require a Traffic Impact Study (TIS), the applicant shall consider the inclusion of walking, bicycling, and transit accommodations within the scope of the encroachment. The applicant shall review walking, bicycling, and transit plans from Metropolitan Planning Organizations (MPOs), Councils of Government (COGs), and regional transit providers to determine the scope of accommodations for complete streets. Coordination with the District Permit Engineer is required to determine if the inclusion of walking, bicycling, and transit accommodations are conducive for implementation based on the scope of the encroachment.
